21 January 2020 at Novi Pazar, within the project “Hate Crimes Moot Court for Young Lawyers of Southwestern Serbia” mentor session on topic: “Identifying the elements of the criminal offence of hate crimes and crimes with hatred elements” is realized.
Mentor session was held by prof. dr Emir Ćorović, associate professor of Department for law sciences, State University of Novi Pazar.
The aim of this mentoring session is to familiarize the program participants with the way of determining the element of being a crime with the element of hatred, as well as determining the motive of hate within the meaning of Article 54a of Criminal Code in case of criminal offences where the motive of hate is not contained in the provision by which criminal offence is prescribed. Particular attention has been paid to distinguishing between the purpose, the incentive and the motive, as well as certain substantive legal and criminal procedural issues that arise regarding the application of Article 54a.
