On June 30, starting at 6:00 pm, the promotion of the Manual for hate crime Moot Court was held. It is a publication created as a joint result of the work of mentors and participants in the program “Hate crime Moot Court for young law profesionals of Southwest Serbia”, which was realized in the period from September 2019 to June 2020 with the financial support of the United States Embassy in Serbia.
The authors spoke about the manual: Prof. dr Emir Ćorović, Adnan Baćićanin, Azra Fetahović, Doc. dr Dragana Ranđelović, MSc Samra Dečković and Prof. dr Aleksandar R. Ivanović.
As a result of the overall activities of the project, numerous presentations were created, texts created by mentors engaged in the project, which were intended for the participants of this project. In addition, as a result of the implementation of the project, prosecutorial acts (indictments), submissions (responses to the indictment and property claims), as well as court decisions (judgments) were made as part of the trial simulation. We would like to selflessly share our experience gained in this project with all those who intend to organize a hate crime trial simulation. This Manual also be useful for trainees who start their careers in the police or criminal justice bodies, the bar, but not only for trainees but also for general employees in these institutions, who may find it useful to find their way in procedures that are lead to the existence of a motive of hatred within the meaning of Article 54a of the Criminal Code. Finally, this Manual may be of benefit to representatives of non-governmental organizations dealing with the fight against hate crimes. Education of future holders of police, prosecutorial, lawyer and judicial functions through simulation courtrooms is one of the most efficient ways for young lawyers to get to know the way of applying theoretical knowledge in practice. In this regard, the publication contains topics that were presented to the participants of this program by the mentors, but also submissions, prosecutorial and court decisions that were developed by the participants of the program. By printing this publication, we primarily wanted to help young lawyers in recognizing, understanding and prosecuting hate crimes, ie. By creating such a book, we wanted to make up for the lack of literature dealing with this issue and thus enable young lawyers to gain comprehensive knowledge about hate crimes through the prism of criminal proceedings. Also, we wanted to create a publication that will be able to be used for the preparation and implementation of simulation courts on similar topics. Accordingly, the publication first presents theoretical considerations of the very concept of hate crimes, international standards and an analysis of domestic provisions concerning this institute. The central part presents the work of the competent authorities in the field of combating and preventing hate crimes, and also provides guidelines for detecting, clarifying and proving hate crimes. Then, through the analysis of legal provisions, the phases of criminal proceedings are presented, with guidelines for practical actions in pre-investigation, investigation, indictment and the main part of criminal proceedings, with a special focus on cases of hate crimes. In the following section, guidelines are provided for the preparation of criminal charges, indictments, responses to indictments and verdicts, as well as other submissions, such as a property claim and an appeal against a verdict. The final part of the publication presents simulation cases, as well as indictments and acts and verdicts written by teams during the realization of the competition in trial simulation. Also, propositions for the realization of such an event are given. Accordingly, we hope that this publication will come into the hands of a large number of young lawyers and help them gain a complete picture of the role of the competent authorities in the fight against hate crimes, the authors said during the promotion.
